According to Fire in the United States, a 10-year statistical overview of the U.S. fire situation published by the U. S. Fire Administration, arson was the number one cause of all fires for all occupancies combined. In a 1998, National Fire Prevention Association survey data showed that an estimated 2,705 civilians were injured in intentional fires. It is heartbreaking enough when families suffer from fires that start accidentally; it is a terrible crime when people are injured or die from fires that someone purposely sets. The average dollar loss per arson is $11,000, including all property types covered in the FBI's definition of arson.

This defendant has been charged with arson offenses at 4 separate addresses. The charges filed in this case have a sentencing guideline allowing from an 11 to 39-year prison term. Based on the statistics documented above, these 4 incidents could have had devastating results. Fortunately, there was no loss of life, no serious injury, and property damage on all except one property less than the national average. While a maximum sentence may not be warranted, a significant prison sentence is justified considering the seriousness of the offenses and the possible outcomes. When determining sentencing, please note the defendant's criminal history. A review of the Hamilton County Clerk of Courts web site indicates a prior breaking and entering offense, a prior theft offense, and disorderly conduct offense. The most recent of which occurred earlier in 2006.
