According to Fire in the United States, a 10-year statistical overview of the U.S. fire situation published by the U. S. Fire Administration, arson was the number one cause of all fires for all occupancies combined. In a 1998, National Fire Prevention Association survey data showed that an estimated 2,705 civilians were injured in intentional fires. It is heartbreaking enough when families suffer from fires that start accidentally; it is a terrible crime when people are injured or die from fires that someone purposely sets. The average dollar loss per arson is $11,000, including all property types covered in the FBI's definition of arson.

This defendant has been charged with arson offenses at 4 separate addresses. The charges filed in this case have a sentencing guideline allowing from an 11 to 39-year prison term. Based on the statistics documented above, these 4 incidents could have had devastating results. Fortunately, there was no loss of life, no serious injury, and property damage on all except one property less than the national average. While a maximum sentence may not be warranted, a significant prison sentence is warranted considering the seriousness of the offenses and the possible outcomes. When determining sentencing, please note the defendant's criminal history. While no previous felony convictions are found, a review of the Hamilton County Clerk of Courts web site indicates a host of misdemeanors beginning in 1995 with one as recently as 2006.
